Written to follow the Telephone Consumer Protection Act (TCPA, 47 U.S.C. §227) and FCC rules (47 C.F.R. §64.1200), the CTIA Messaging Principles and Best Practices, the CTIA Short Code Monitoring Handbook (if a short code is used), and carrier 10DLC requirements. [LAWYER] Confirm against current FCC rules (including 2024–2025 consent/revocation rule changes) and state "mini-TCPA" laws (e.g., Florida FTSA, Oklahoma OTSA).
1. Program description
- Program name: IGNIS by Saphira Scam Check Alerts
- What it does: You text us suspicious messages or screenshots; we text back a scam verdict. Account Holders get scam alerts about their Protected Member and may get a weekly scam briefing.
- Message frequency: Varies. Replies are sent only when you text us; alerts as they happen; briefing about 1 per week. [OWNER: state typical max, e.g., "up to ~10 msgs/week"]
- Msg & data rates may apply.
- Carriers are not liable for delayed or undelivered messages.
- Terms: https://askignis.com/terms · Privacy: https://askignis.com/privacy · SMS terms: https://askignis.com/sms-terms
We do not make robocalls or send marketing texts to anyone who hasn't consented. Verdicts and alerts are informational/service messages. [BUSINESS DECISION: no marketing texts at all is simplest; if any, get separate marketing consent.]
2. Consent language for web signup forms
Checkbox must be unchecked by default, separate from accepting Terms, and not a condition of purchase for marketing.
For the Account Holder's own phone:
☐ I agree to receive recurring automated text messages from IGNIS by Saphira at the phone number provided, including scam check results, alerts about my family member, and a weekly scam briefing. Consent is not a condition of purchase. Message frequency varies. Msg & data rates may apply. Reply HELP for help and STOP to cancel. See our [Terms] and [Privacy Policy].
For adding the Protected Member's phone (Account Holder screen):
☐ I confirm that [Member name] has agreed to be added to IGNIS by Saphira and to receive texts at this number. I understand IGNIS by Saphira will text them to confirm, and they will not be enrolled unless they reply YES.
[LAWYER — IMPORTANT] The adult child cannot consent on behalf of the parent's phone unless they are the subscriber/customary user of that line or have legal authority (e.g., POA/guardianship). Our design: the parent must confirm from their own phone (double opt-in below). Confirm whether this is sufficient and how to handle family plans where the child pays for the parent's line.
3. Double opt-in confirmation messages (exact text)
To Protected Member (sent once after the Account Holder adds them):
IGNIS by Saphira: [Account Holder first name] invited you to free scam checks. Text us anything suspicious & we'll reply if it's a scam. They'll get alerts. Reply YES to join. Msg freq varies. Msg&data rates may apply. HELP for help, STOP to opt out.
If no YES reply: no further messages (at most one reminder after [48] hours — BUSINESS DECISION; lawyer to confirm).
After YES (welcome):
IGNIS by Saphira: You're in! Forward or screenshot any suspicious text, email or link to this number. Never send passwords or card numbers. Msg freq varies. Msg&data rates may apply. Reply HELP for help, STOP to cancel. Terms: https://askignis.com/terms
Account Holder confirmation:
IGNIS by Saphira: Reply YES to confirm scam alerts & weekly briefing at this number. Msg freq varies. Msg&data rates may apply. HELP for help, STOP to cancel.
4. Keyword handling (exact auto-replies)
| Keywords (case-insensitive) | Action | Auto-reply |
|---|---|---|
| STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, OPTOUT | Opt out immediately; send one final confirmation; no further texts | "IGNIS by Saphira: You're unsubscribed and will get no more texts. Reply START to rejoin. Help: [PLACEHOLDER: support email]" |
| HELP, INFO | Send help | "IGNIS by Saphira: Text us suspicious messages for a scam verdict. Help: [PLACEHOLDER: support email] or [PHONE]. Msg freq varies. Msg&data rates may apply. Reply STOP to cancel." |
| START, YES, UNSTOP | Re-subscribe (only if previously consented) | "IGNIS by Saphira: You're subscribed again. Msg freq varies. Msg&data rates may apply. HELP for help, STOP to cancel." |
- Also honor opt-outs sent in plain words ("stop texting me," "leave me alone") — FCC rules say consumers may revoke consent by any reasonable means. Flag such messages for review and opt out within the required time. [LAWYER] confirm the timeline (FCC revocation rule: honor within 10 business days; best practice is immediately).
- Older users may type STOP inside a forwarded scam message. [OWNER/ENGINEERING] Only treat STOP as opt-out when it's the whole message (or nearly), and confirm ambiguous cases.
- Opting out of SMS also stops Account Holder alerts by text; email alerts continue unless also turned off.
5. Quiet hours
Reply messages go out when the user texts us (any time). Non-reply messages (alerts that aren't urgent, weekly briefings, reminders) are sent only 8:00 a.m.–9:00 p.m. recipient's local time (TCPA safe harbor), and stricter where state law requires (e.g., Florida/Oklahoma 8 a.m.–8 p.m.). [LAWYER] confirm.
6. Consent records
For each number keep: phone number, name, date/time (UTC), consent method (web form/keyword), exact consent language & form version shown, IP address/user agent (web), the YES confirmation message, and all opt-out/opt-in events. Keep for at least 5 years after the last message (suggested; TCPA statute of limitations is 4 years) — [LAWYER] confirm.
7. 10DLC / carrier registration
Before launch, register the brand and campaign with The Campaign Registry (TCR) through our SMS provider ([PROVIDER]), or use a verified toll-free number. Campaign use case: likely "Customer Care"/"Account Notifications" or mixed. Submit sample messages, opt-in flow screenshot, and links to these terms and the privacy policy. Privacy policy must state that mobile opt-in data is not shared with third parties for marketing. Update the registration if message content changes.
8. Other rules
- No texting numbers that haven't consented; no buying/renting lists.
- Check the FCC Reassigned Numbers Database periodically for numbers that have changed owners. [LAWYER: confirm usefulness for safe harbor.]
- No SHAFT content (sex, hate, alcohol, firearms, tobacco) per CTIA. Note: we may quote scam content in replies—avoid repeating links verbatim; defang them (e.g., "hxxp://bad[.]com") so carrier filters don't block us.
